Your blind measurements are not your personal data as they are facts about your blinds, not about you, and we do not use them to form an opinion about you.

    We want to give you the best possible customer experience. One way to achieve that is to get the richest picture we can of who you are by combining the data we have about you. We then use this to offer you promotions, products and services that are most likely to interest you.

    In order to pursue our legitimate interests as a company, we have installed CCTV in some of our premises. This allows us to monitor the safety of visitors, assists in day to day management, and acts as a deterrent against crime, vandalism and disruption.

    How we protect your data

    We take the security of your data seriously. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by its employees in the performance of their duties.

    We regularly monitor our system for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security.

    Where we engage with third parties to process personal data on our behalf, we do so, on the basis of written instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of data.

    How long we keep your data for

    We will not keep your personal data for longer than is necessary for the purpose or purposes that it was initially collected. At the end of that retention period, your data will either be securely deleted or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning. Some examples of retention periods are below:

    When you call us by telephone we may record the conversation, if we do this will be held for a maximum of 12 months unless the call is required for the resolution of an ongoing dispute.

    If you place an order with us we have to retain the details of the order, including your personal data, for 10 years to comply with our legal and contractual obligations. If the order included a warranty which was for a longer period than this, and you have registered that warranty with us, we will keep details of the warranty period and any associated personal data for the duration of the warranty period.

    Who we share your personal data with

    We will share your personal information with third parties set out below

    Partners and Service providers

    We apply the following policy when we share your personal information with external organisations

    • We provide only the information they need to perform their specific services.

    • They may only use your data for the exact purposes we specify in our contract with

    them.

    • We work closely with them to ensure that your privacy is respected and protected at

    all times.

    • If we stop using their services, any of your data held by them will either be deleted

    or rendered anonymous.

    We work with carefully selected Service Providers that carry out certain functions on our behalf. These include, for example, companies that help us with technology services, stor- ing and combining data, processing payments and delivering orders. We only share per- sonal data that enable our Service Providers to provide their services.

    Some of the Service Providers we work with operate online media channels, and they place relevant online advertising for our products and services, as well as those of our suppliers and our Retail Partners, on those online media channels on our behalf. For ex- ample, you may see an advert for our products and services as you use a particular social media site or watch television through your pay TV account.

    In addition to our use of service providers, we may also disclose your personal data to our suppliers or subcontractors in order to provide you with the Services you have requested from us.

    We may disclose your personal data on the basis of our legitimate interests to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

    Financial transactions relating to our website and services are handled by our payment services providers. We share your information with them in so that we can process your payments, and deal with complaints and queries relating to these payments and/or re- funds.

    Once you have clicked on the ‘purchase template’ button and received the confirmation email you will be sent a permission link via email to allow you full access to your new Squarespace template.

    Payment

    We accept the following credit cards and debit cards: Visa, Mastercard and American Express and through Paypal: Visa, Mastercard, Maestro, American Express. We do not accept cash or cheques.

    We will do all that we reasonably can to ensure that all of the information you give us when paying for the digital content is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

    Your credit card or debit card will only be charged when you purchase the digital content.

    All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via:

    The price of the digital content:

    is in pounds sterling (£)(GBP);

    may change at anytime by our own discretion

    Nature of the digital content

    The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, that the digital content:

    is of satisfactory quality;

    is fit for purpose; and

    matches its description.

    We must provide you with digital content that complies with your legal rights.

    When we supply the digital content:

    we will use all reasonable efforts to ensure that it is free from defects; viruses and other malicious content

    we do not promise that it is compatible with any third party software or equipment except where we have said that it is in the guide to its use or on our website; and

    you acknowledge that there may be minor errors or bugs in it.

    End of the contract

    If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

    Limit on our responsibility to you

    Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for:

    losses that:

    were not foreseeable to you and us when the contract was formed; or

    that were not caused by any breach on our part

    business losses; and

    losses to non-consumers

    Disputes

    We will try to resolve any disputes with you quickly and efficiently.

    If you are unhappy with:

    the digital content;

    our service to you; or

    any other matter;

    Please contact us as soon as possible.

    Third party rights

    No one other than a party to this contract has any right to enforce any term of this contract.

Terms of Service

Graphic design, branding & ongoing marketing

The following Terms of Service are set out for services provided by Toni Williams (Trading as The Square Genius)

    The following Terms and Conditions of Service apply to all artwork, graphic design, print and other services provided by Toni Williams (T/A The Square Genius).

    All design work is carried out by  Toni Williams (T/A The Square Genius) on the understanding that the client has agreed to abide by Toni Williams’s (T/A The Square Genius)  terms and conditions.

    Copyright of all graphic design work is retained by  Toni Williams (T/A The Square Genius)  including copy, concepts, ideas, proofs and illustrations (unless specifically released in writing) until after all invoices have been settled.

    If multiple design concepts are submitted, only one concept is deemed to be given by Toni Williams (T/A The Square Genius) as fulfilling the contract. All other artwork designs remain the property of Toni Williams (T/A The Square Genius), unless agreed in writing.

    Project Acceptance

    At the time of proposal,  Toni Williams (T/A The Square Genius)  will provide the customer with a written estimate or quotation. The Terms and Conditions can be read on Toni Williams’s (T/A The Square Genius) website.

    A copy of the written estimate or quotation is to be approved  by the customer to indicate acceptance.  Alternatively, the client may send an official order in reply to the estimate or quotation which binds the client to accept  Toni Williams’s (T/A The Square Genius) terms and conditions.

    Design Fees

    Fees for design services to be provided by Toni Williams (T/A The Square Genius), this will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer's stated acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% of the quoted fee may be required depending on the job size, this will be communicating upon receipt of the estimate or quote. Work on the project will not commence until Toni Williams (T/A The Square Genius) has received this amount.

    Charges for Other Services

    Charges for any additional services over and above the estimated design, will become fully payable at the time of project acceptance.

    Payment

    The client will be asked to provide artwork sign off before followed by an Invoice prior to print/artwork/publication. At this time the remainder of the fees due will become payable. Accounts which remain outstanding for 30 days after the date of invoice, will incur an extra charge of 25% per month of the outstanding amount.

    Payments may be made by Bacs, cash, cheque, or (for overseas customers), Paypal or previously agreed electronic funds transfer.

    Publication and/or release of work done by Toni Williams (T/A The Square Genius) on behalf of the client, may not take place before funds have cleared.

    Returned cheques will incur an additional fee of £50 per returned cheque. Toni Williams (T/A The Square Genius)  reserves the right to cancel any ongoing services if a cheque is returned.

    Default

    An account shall be considered default if it remains unpaid for 30 days from the date of invoice, or following a returned cheque.  Toni Williams (T/A The Square Genius) shall be considered entitled to remove  Toni Williams (T/A The Square Genius) 's and/or the customer's material from any and all computer systems, until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, design and maintenance, sub-contractors, printers, photographers and libraries.

    Removal of such materials does not relieve the customer of it's obligation to pay the due amount.

    Copyrights and Trademarks

    By supplying text, images and other data to Toni Williams (T/A The Square Genius) for inclusion in the customer's printed content or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.

    Any artwork, images, or text supplied and/or designed by  Toni Williams (T/A The Square Genius) on behalf of the customer, will remain the property of  Toni Williams (T/A The Square Genius) and/or it's suppliers, excluding Logo design in which full copyright will be passed to the client upon receipt of full payment.

    The customer may request in writing from  Toni Williams (T/A The Square Genius), the necessary permission to use materials (for which  Toni Williams (T/A The Square Genius)  holds the copyright) in forms other than for which it was originally supplied, and  Toni Williams (T/A The Square Genius)  may, at it's own discretion, grant this. Raw artwork files will not be supplied unless agreed in writing in advance by  Toni Williams (T/A The Square Genius). Such permission must be obtained in writing before it will allow any of the aforesaid artwork, images, text, or other data to be used.  Toni Williams (T/A The Square Genius) reserves the right to charge fees for additional usage.

    By supplying images, text, or any other data to  Toni Williams (T/A The Square Genius) , the customer grants Toni Williams (T/A The Square Genius)  permission to use this material freely in the pursuit of the design and to utilise the designs in  Toni Williams (T/A The Square Genius) 's portfolio unless agreed otherwise.

    Should  Toni Williams (T/A The Square Genius) , or the customer supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow  Toni Williams (T/A The Square Genius) to remove and/or replace the file.

    The customer agrees to fully indemnify and hold  Toni Williams (T/A The Square Genius) free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.

    Alterations

    The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.

    The customer also agrees that  Toni Williams (T/A The Square Genius) holds no responsibility for any amendments made by any third party, before or after a design is published.

    Licensing

    Any design, copywriting, drawing, idea created for the customer by  Toni Williams (T/A The Square Genius) , or any of it's contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Toni Williams (T/A The Square Genius)  and any of it's relevant sub-contractors.

    All design work where there is a risk that another party may make a claim, should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use.  Toni Williams (T/A The Square Genius) will not be held responsible for any and all damages resulting from such claims. 

     

    Toni Williams (T/A The Square Genius) is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold  Toni Williams (T/A The Square Genius) responsible for any such loss or damage.  Any claim against  Toni Williams (T/A The Square Genius) shall be limited to the relevant fee(s) paid by the customer.

    Data Formats

    The client agrees to Toni Williams’s (T/A The Square Genius) definition of acceptable means of supplying data to the company.

    Text is to be supplied to Toni Williams (T/A The Square Genius) in electronic format as standard text (.txt), MS Word (.doc) on USB, or via e-mail.

    Images which are supplied in an electronic format, are to be provided in a format as prescribed by  Toni Williams (T/A The Square Genius) via USB, or electronic data format. Images must be of a quality suitable for use without any subsequent image processing, and  Toni Williams (T/A The Square Genius) will not be held responsible for any image quality which the client later deems to be unacceptable.  Toni Williams (T/A The Square Genius) cannot be held responsible for the quality of any images which the client wishes to be scanned from printed materials.

    Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion, digital image processing, or data entry services.

    Design Project Duration

    Any indication given by  Toni Williams (T/A The Square Genius) of a design project's duration is to be considered by the customer to be an estimation. Toni Williams (T/A The Square Genius) cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds of a deposit are received by  Toni Williams (T/A The Square Genius).

    Design Project Completion

     Toni Williams (T/A The Square Genius) considers the design project complete upon receipt of the customer's sign off. Other services such as printing, display panel production, filmwork, website content, publishing etc either contracted on the clients behalf constitute a separate project and can be treated as a separate charge.

    Website Design Only

    Once web design is complete,  Toni Williams (T/A The Square Genius) will provide the customer with the opportunity to review the resulting work.  Toni Williams (T/A The Square Genius) will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to  Toni Williams (T/A The Square Genius) by e-mail.

    Toni Williams (T/A The Square Genius) will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review period.

    Design Credits

    The customer agrees to allow  Toni Williams (T/A The Square Genius) to place a small credit on printed material, exhibition displays, advertisements and/or a link to  Toni Williams (T/A The Square Genius) 's own website on the customer's website. This will usually be in the form of a small logo or line of text placed towards the bottom of the page.

    The customer also agrees to allow  Toni Williams (T/A The Square Genius) to place all designs on Toni Williams (T/A The Square Genius) 's own website for portfolio and demonstration purposes and to use any designs in its own publicity unless agreed otherwise.

    Rights of Refusal

    Toni Williams (T/A The Square Genius) will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.  Toni Williams (T/A The Square Genius) also reserves the right to refuse to include submitted material without giving reason. Any images and/or data that  Toni Williams (T/A The Square Genius) does include in all good faith, and then finds out that it contravenes these Terms and Conditions, the customer is obliged to allow  Toni Williams (T/A The Square Genius) to remove the contravention without hindrance, or penalty.  Toni Williams (T/A The Square Genius) is to be held in no way responsible for any such data being included.

    Cancellation

    Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this,  Toni Williams (T/A The Square Genius) will need formal notification in writing. The client will then be invoiced for all work completed  that will have been made at the time of first ordering. The balance of monies due must be paid within 7 days of receipt of the invoice. Please note: any cancellation which is not formally confirmed in writing and received by  Toni Williams (T/A The Square Genius) within 7 days of such instruction being issued, will be liable for the full quoted cost of the project.

    Disclaimer

    Toni Williams (T/A The Square Genius) makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies.  Toni Williams (T/A The Square Genius) will not be held responsible for any and all damages resulting from products and/or services it supplies. Toni Williams (T/A The Square Genius) is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Toni Williams (T/A The Square Genius) responsible for any such loss or damage. Any claim against  Toni Williams (T/A The Square Genius) shall be limited to the relevant fee(s) paid by the customer.

    Toni Williams (T/A The Square Genius) reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. Toni Williams (T/A The Square Genius)  will not knowingly perform any actions to contravene these and the client also agrees to be so bound.

    Toni Williams (T/A The Square Genius) and its clients agree to comply with Printers Terms and Conditions which include disclaimers for non-completion on time and the flexibility to supply quantities within 10% of the total ordered.  Toni Williams (T/A The Square Genius) recommends that if an exact quantity is required, then 10% extra is added to the quantity and extra time made available should the job be delayed.

    General

    These Terms and Conditions supersede any previous Terms and Conditions distributed in any form.  Toni Williams (T/A The Square Genius) reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.

    Acceptance of Quotation and Terms and Conditions

    The placement of an order for design and/or any other services offered by  Toni Williams (T/A The Square Genius) and validated by the customers on the estimate or quotation, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the customer and  Toni Williams (T/A The Square Genius).
